Terms of Service

The Terms and Conditions outlined below are intended to avoid misunderstandings and provide clarification in the unlikely event of a dispute. If you hire me to work for you, you confirm that you have read and agree.

1. Quotes and Proposals

Before commencing work, I will supply a full breakdown of costs in a quote or a written proposal. All quotes are valid for 21 days.

I require a signed proposal as written confirmation that you are commissioning me to work for you and that you agree to the quoted pricing before I start.

2. Payment

Prices are quoted as $NZD. GST will be added to all payments.

A non-refundable deposit is required before work can begin. Your proposal or quote will include payment and invoicing information.

Unless otherwise arranged, invoices must be paid in $NZD via bank transfer (preferred), credit card, PayPal, or Wise Quick Pay within 14 days of receipt. PayPal payments incur a 3.4% transaction fee plus a 2.5% foreign exchange fee.

If your work is urgent and requires a turnaround of less than 7 working days, Choice Digital reserves the right to turn down the work or to charge a 25% rush loading fee. If that’s the case, it will be discussed with you before the work begins.

3. Changes in Scope

Any rework due to a change in direction at the client’s end are a change in scope, and a new quote will be submitted before commencing this work.

Any modifications to the brief during execution will render the provided quotation invalid. Additional fees/charges may be applied to cover the time and expenses required to complete any new work. Before work can restart, the new quote must be approved, and the revised initial payment must be paid.

4. Point of Contact

You will nominate one primary contact for all communication and revisions throughout the work. Unless previously discussed, if you do not communicate with me for 30 days, the work will cease, and any final charges will be invoiced.

5. Additional Meetings (either face-to-face or online)

Additional meetings can be added at your request. However, these will be charged at an hourly rate of $150 per hour + GST and include any necessary travel time. Meetings cancelled less than 24 hours beforehand will still be charged.

6. Timeframes/Deadlines

I endeavour to deliver all work by the agreed deadline. However, circumstances beyond my control – including major illness or family emergencies – may prevent me from getting work to you within the agreed timeframes.

If there are any timeframe issues, I will inform you within two business days. Unless otherwise agreed, you will provide me with information and revisions within a timely manner (7-10 days).

If I am unable to complete the work due to missing information from you, I will make every effort to accommodate your project within my schedule and proceed accordingly. However, this may necessitate adjustments to the agreed timeline.

7. Expenses

You will not be charged for any minor, out-of-pocket expenses – including travel to meetings, phone calls, internet, email, or courier. In the unlikely event that a chargeable expense becomes necessary, you will be notified in advance.

8. Copyright

You are solely responsible for ensuring that any provided content (including text, images, or other media) does not infringe upon third-party copyrights or intellectual property rights. Any materials you submit must be owned or properly licensed for use.

I endeavour to ensure that my work doesn’t infringe upon third-party copyrights or intellectual property rights. I am responsible for ensuring that any images or media that I purchase or obtain are legally safe to use without infringing copyright.

9. Use of AI and Plagiarism

I may use AI tools to assist with content generation, idea development, or editing. However, all content is reviewed and refined to ensure quality and relevance to the client’s needs.

I make every effort to ensure the originality of my work and may use plagiarism detection tools to check for duplicate content. However, no tool guarantees 100% accuracy, and I cannot be held liable for any undetected plagiarism.

You, the client, are responsible for checking plagiarism, verifying originality, and ensuring compliance with copyright laws.

10. Claims and liabilities

I am not liable in any way for any direct, indirect, incidental, special, or consequential losses or damages resulting from the use of services, including but not limited to loss of data and other intangibles; costs or damages resulting from or related to any services

purchased or obtained, or resulting from unauthorised access to, or alteration of your transmissions or data.

You agree to indemnify and to hold me harmless against all claims, costs, and expenses, including solicitors’ fees, due to materials included in any work undertaken at your request. All materials you provide are assumed to be legal and accurate.

You are responsible for checking the factual accuracy of the content for this work. I work hard to ensure my work is error-free but don’t offer an error-free guarantee. If I make a mistake that can be corrected, I will do so as soon as possible, free of charge.

Once you have approved the work and published it, I am not responsible for the material or its use.

11. Confidentiality

I will not disclose any information you identify as confidential. I am happy to sign whatever confidentiality or non-disclosure agreements you or your organisation deem necessary. You agree not to disclose any information about Choice Digital’s pricing structure or intellectual property.

12. Privacy

I am the only person who has access to your personal information, as I do not work with other staff. I will collect personal information such as your name, business name, business address, and contact email address.

I will add your contact details to an electronic accounting system and to my mailing list. I may record our meetings to assist with the copywriting process. I keep your information safe by storing it in encrypted files. I do not keep any hard copies.

I will also collect information about your business, including your services, pricing information, and marketing spending, to enable me to provide you with a digital marketing service. This information is strictly confidential and will not be disclosed.

I keep your information for two years, at which point I securely destroy it by erasing all data. You have the right to ask for a copy of any personal information I hold about you and to ask for it to be corrected if you think it is wrong.

13. Showcasing Your Project

I reserve the right to refer to this work and your business name and to use your logo and content for promotional or educational purposes unless you have signed a Non-Disclosure Agreement (NDA) expressly asking me not to.

I may approach you for a testimonial after the project is completed to your satisfaction, although providing the testimonial is not obligatory.

14. Late Payment

If payment is not made in full within 14 days of receipt of the invoice, you may face a late payment charge on the outstanding amount of an additional 10% fee for each month it is overdue.

If a third-party organisation is engaged to recover debt, you will be responsible for paying the additional costs involved, including any legal expenses.

15. Cancellation

If you choose to terminate the provision of my services after paying a deposit, the deposit is non-refundable. If cancellation occurs after work has commenced and the value of work completed exceeds the deposit amount, you will be invoiced for the full amount of the current stage in progress.

I may terminate the contract at any time via email. If I do so, I will invoice for the full amount of the total stage in progress minus the deposit.

16. Hours of Work

My office hours are Monday to Friday between 9:00 a.m. and 3:00 p.m. NZT. I will respond to messages or calls received outside these hours the next business day.

My office hours will change during the school holidays, but I will notify you in advance should your work be affected.

17. Your Satisfaction

I believe in working with my clients in an open and respectful way. I want you to be totally happy with the work I do for you. However, misunderstandings can happen.

If you are not happy for any reason, please discuss your concerns with me, and I will do my utmost to give you something you are happy with.

If you have given me an opportunity to address your concerns and you still consider that the work that I have submitted does not meet your brief, either party can cancel the contract (e.g. by email). This is entirely without prejudice, and no liability or admission of failure or inability to complete the contract on my part is implied. Any work that has been created up until this point must be paid.

18. Governing Law

These terms and conditions are governed by New Zealand law, and the Courts of New Zealand have exclusive jurisdiction if there is a dispute.

Choice Digital reserves the right to change these terms and conditions, including fees, at any time.
